1. Service Description

Abby SEO provides a free, automated SEO scanning tool that analyzes publicly accessible websites for common search engine optimization issues. The Service checks for items such as sitemaps, robots.txt configuration, schema markup, canonical tags, meta tags, and other SEO factors, and provides general remediation guidance.

2. Eligibility

You must be at least 13 years old (or 16 in the EEA/UK) to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

  • Scan websites you do not own or do not have explicit authorization to scan
  • Use the Service to conduct security testing, vulnerability scanning, or penetration testing
  • Attempt to overload, disrupt, or interfere with the Service or its underlying infrastructure
  • Circumvent or attempt to circumvent rate limits, access controls, or other protective measures
  • Use automated tools, bots, or scripts to access the Service in a manner that exceeds reasonable use
  • Use scan results to harass, defame, or harm the owners of scanned websites
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Reproduce, redistribute, or commercially exploit scan results or any content from the Service without our written permission
  • Use the Service in any way that violates applicable local, state, national, or international law

4. Rate Limits and Access

The Service is subject to rate limiting to ensure fair access and prevent abuse. We reserve the right to:

  • Impose or modify rate limits at any time without prior notice
  • Temporarily or permanently block access from IP addresses that engage in abusive behavior
  • Restrict or suspend access to the Service at our sole discretion

By submitting URLs or other content to the Service, you represent that you have the right to do so. You retain ownership of any content you submit, but you grant us a limited, non-exclusive license to process that content as necessary to provide the Service.

7. Disclaimers

  • Uninterrupted or error-free operation of the Service
  • Compatibility with all websites, platforms, or configurations

SEO recommendations are provided as general informational guidance only and do not constitute professional advice. Scan results may not be exhaustive and may not reflect the current state of the scanned website at the time you view them. You are solely responsible for evaluating the applicability of any recommendation to your specific situation.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ABBY SEO, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your reliance on scan results or recommendations
  • Damages resulting from unauthorized access to or alteration of your data
  • Damages arising from any interruption or cessation of the Service

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Abby SEO, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your scanning of websites without proper authorization
  • Any claim by a third party related to your use of the Service

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without prior notice or liability. Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 8, 9, 11, and 12 shall survive termination.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA), with the arbitration conducted in Lake County, Illinois. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

12. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Abby SEO regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • No Agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Abby SEO.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
